Summery of FWC Regulations and Requirements |
| The gopher tortoise is classified by the FWC as a
Threatened Species in
Florida. Gopher tortoise burrows are afforded the same legal protection by the FWC as gopher tortoises. The FWC policy requires landowners to minimize impacts to gopher tortoises and gopher tortoise burrows by Avoidance or Relocating affected gopher tortoises prior to any site alterations. The gopher tortoise management plan and permit guidelines limit gopher tortoise related activities to well qualified individuals that posses an Authorized Agent Permit issued by the FWC, the permit authorizes only those activities that the permit holder is well qualified to perform. Given the presence of the gopher tortoise, several commensal species have a moderate potential for occurring on the project site including eastern indigo snake (Drymarchon corais), Florida mouse (Podomys floridanus), Florida pine snake (Pituophis melanoleucus mugitus), and gopher frog (Rana areolata). If these commensals are found on-site, the Authorized Agent may relocate these species as well. The FWC requires that captured tortoises receive a health assessment,
